1. Scope of Application

These Terms and Conditions apply to all contracts concluded via the online shop between

represented by the partners Nina Harder & Fabian Tofern

– hereinafter referred to as the “Seller” –

and the customer.

The offer is directed exclusively at consumers within the meaning of Section 13 of the German Civil Code (BGB).

2. Products

The Seller offers physical products only, in particular:

  1. Art prints (limited, numbered, print-on-demand)

  2. Art posters (limited, numbered, print-on-demand)

  3. Original artworks

No digital products are offered.

3. Conclusion of Contract

(1) The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.

(2) A contract is concluded when the customer completes the order process and clicks the corresponding button (e.g. “Buy now”).

(3) After placing an order, the customer will receive an order confirmation by email.

4. Contract Language

The contract language is German and English.
In case of discrepancies, the German version shall prevail.

5. Prices and Payment

(1) All prices are final prices including statutory VAT.

(2) Unless otherwise stated, shipping costs are €4.99. Different shipping costs may apply as part of promotions or special offers and will be clearly displayed during the ordering process.

(3) The following payment methods are available:

    • Maestro
    • PayPal
    • American Express
    • Google Pay
    • Klarna
    • Mastercard
    • Union Pay
    • Visa

(4) The purchase price is due immediately upon conclusion of the contract.

(5) In the event of late payment, the Seller reserves the right to issue a first and second reminder.

6. Delivery and Shipping

(1) Delivery is made exclusively within Germany.

(2) Delivery times may vary depending on the product and are stated in the shop.

(3) If a product is unavailable, no contract shall be concluded. Any payments already made will be refunded.

7. Transfer of Risk

The risk of accidental loss or deterioration of the goods passes to the customer only upon delivery of the goods to the customer.

8. Retention of Title

The goods remain the property of the Seller until full payment has been made.

9. Right of Withdrawal

Exclusion of the Right of Withdrawal

The right of withdrawal is excluded for:

  1. Art prints produced as print-on-demand, limited and numbered
  2. Art posters produced as print-on-demand, limited and numbered
  3. Original artworks

10. Warranty

(1) Statutory warranty rights apply.

(2) Obvious defects must be reported immediately.
The customer is required to provide meaningful photographic evidence.

(3) After review, the Seller will, at its discretion:

  1. provide a replacement, or

  2. issue a refund.

(4) In the case of original artworks:

  1. the artwork must be returned to the GbR, and

  2. a refund will be issued thereafter.

11. Liability

The Seller is liable only for intent and gross negligence.
In cases of slight negligence, liability exists only for the breach of essential contractual obligations and is limited to foreseeable damages.

Liability under the Product Liability Act remains unaffected.

12. Copyright and Usage Rights

(1) All designs, artworks, texts and content are protected by copyright.

(2) The authors of the works displayed on this website are the respective partners of Harder & Tofern GbR as natural persons.

The copyright usage rights are held by Harder & Tofern GbR and are regulated internally by contract.

The public presentation of the works is carried out under the brand Vervyn, which acts as the outward-facing entity.

Works created in collaboration with external artists are identified accordingly; the type and extent of author attribution are determined by the respective contractual agreement.

The allocation of the works is carried out additionally through an internal work directory.

(3) By purchasing a product, the customer acquires ownership of the physical product only.

(4) Any use beyond private use is prohibited unless expressly agreed otherwise.

13. Misuse and Fraud Prevention

The Seller reserves the right to cancel orders in the event of suspected misuse or fraudulent activity.

14. Vouchers, Discounts, and Pre-Orders

(1) Vouchers and discount codes may be limited in time or quantity.

(2) Pre-orders and limited drops are subject to special conditions communicated in the shop.

15. Applicable Law and Jurisdiction

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

The place of jurisdiction shall be the registered office of the GbR, insofar as legally permissible.

16. Storage of Contract Text

The contract text is stored and made available to the customer by email.

17. Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected.
